Prior Review of Land Transfer
Description: Before adjoining property owners modify the location of a common lot line (as allowed by state law), the proposal must be reviewed by staff to make sure both of the parcels comply with all zoning standards.
 
Decision maker(s): Zoning administrator
 
Basis of decision: In determining whether to grant approval, the zoning administrator needs to ensure both of the lots, and any existing improvements on the lots, comply  with all applicable zoning standards, including lot size, lot frontage, building setbacks, number of buildings, and floor area.
 
Review process:
  1. Submittal of application materials. The applicant shall submit a completed application and other required materials to the zoning administrator along with the application fee as may be established by the Town Board.
  2. Staff review. Within 10 days of receiving the application and other required materials, the zoning administrator shall either determine that the application is incomplete and notify the applicant, in writing, of the deficiencies and that the applicant has 3 months from the date of such determination to resubmit the application or forfeit the application fee, if any, or make a decision to (i) approve the application, (ii) approve the application with conditions, or (iii) deny the application. The zoning administrator shall take no further steps to process the application until the deficiencies are remedied. The incomplete application shall be retained as a public record.
  3. Applicant notification. Within a reasonable time following his or her decision to approve or deny the application, the zoning administrator shall mail the decision notice to the applicant by regular mail or email.
  4. Public record copy. A copy of the decision notice is kept as a public record.

The following are involved in the review of this type of application.

The Town Board is the governing body of the Town of Mukwonago and is responsible for making decisions on local policies, budgets, and ordinances. The board also reviews certain types of development projects. The board consists of 5 members who are elected to two-year, overlapping terms.

The Plan Commission is a 7-member body established by the Town Board to review certain development projects and act on other matters. Depending on the type of the development proposal, the commission may be advisory to the Town Board or have the authority to make the final decision. Three members also serve on the Town Board; the remaining members are town residents.

Planning staff provides technical support to the Town Board, Plan Commission, Zoning Board of Appeals, developers, neighbors, and other interested parties to facilitate the development review process.
